Introduction

These Terms and Conditions ("Terms") govern your use of the website www.tropicurebliss.com and the services provided by Tropicure Bliss ("we," "us," or "Company"). By booking a service with us, you agree to comply with and be bound by these Terms.

Nature of Services

Tropicure Bliss acts solely as a Medical Travel Facilitator and Concierge. We are NOT a medical provider. We do not provide medical advice, diagnosis, or treatment.

• Our Role: We coordinate logistics, including travel, accommodation, and communication between you and third-party medical providers (such as Hemas Hospitals).
• Medical Decisions: All decisions regarding your medical care are made exclusively between you and your treating doctor/hospital. We do not influence or control clinical judgment.

Medical Disclaimer and Liability

• No Medical Advice: Information provided on our website or by our team is for informational purposes only and does not constitute medical advice.
• Third-Party Liability: You acknowledge that the medical services are provided by independent third-party hospitals and doctors. Tropicure Bliss is not liable for any medical negligence, malpractice, treatment outcomes, complications, or side effects arising from the medical services you receive.
• Assumption of Risk: You voluntarily assume all risks associated with medical travel and medical procedures.

Booking and Payments

• Quotes: Treatment quotes provided are estimates based on the medical information you submit. The final cost may vary based on your actual medical condition as determined by the doctor upon physical examination in Sri Lanka.
• Payment: You agree to pay the package price as per the invoice provided. Payments may be collected by us on behalf of the medical provider or for our concierge services.
• Additional Costs: Any unforeseen medical complications or additional procedures required during your stay will be billed directly by the hospital, and you are responsible for settling these costs.

Refund and Cancellation Policy

We understand that plans can change. Our refund policy is designed to be fair while covering the administrative costs and commitments made to our partners.

Cancellations made more than 30 days before arrival: We will provide a Full Refund, minus administrative fees incurred (such as bank transfer charges or non-refundable deposit fees paid to third parties).

Cancellations made between 15 to 30 days before arrival: We will refund 70% of the total package value paid.

Cancellations made between 8 to 15 days before arrival: We will refund 50% of the total package value paid.

Cancellations made less than 8 days before arrival: No refund will be provided.

Note: Refunds will be processed to the original method of payment within a reasonable timeframe. Third-party costs already disbursed by us (e.g., visa fees, non-refundable hotel bookings) are not refundable regardless of the cancellation window.*

User Obligations

• Accuracy of Information: You agree to provide accurate, complete, and up-to-date medical history and personal information. We are not responsible for errors in quotes or treatment plans resulting from incomplete information.
• Travel Documents: You are solely responsible for obtaining a valid passport and the necessary visa for entry into Sri Lanka.
• Compliance: You agree to follow the rules and regulations of the hospital and the laws of Sri Lanka during your stay.

Limitation of Liability

To the fullest extent permitted by law:

Tropicure Bliss shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of our services.

Our total liability to you for any claim arising out of these Terms or our services is strictly limited to the fees paid by you to Tropicure Bliss for our concierge/facilitation services (excluding the portion of fees paid to medical providers).

Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Tropicure Bliss or its content suppliers and is protected by intellectual property laws. You may not use our content without our express written permission.

Dispute Resolution and Governing Law

Governing Law: These Terms shall be governed by and construed in accordance with the laws of Sri Lanka.

Dispute Resolution: In the event of a dispute, the parties shall first attempt to resolve it amicably through negotiation. If unresolved, the dispute shall be submitted to arbitration in Colombo, Sri Lanka. However, we reserve the right to seek injunctive relief in any competent court to protect our intellectual property or business interests.

Amendments

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of the modified Terms.
